Customer Waiver & Terms of Participation

Please read this waiver carefully before booking. By making a booking and ticking the acceptance box, you confirm that you have read, understood and agreed to these terms.

1. About the Experience

The Mad Splatter provides paint-splatter and creative experiences involving paint, movement and other materials.

Activities can be messy, energetic and unpredictable. Paint may be thrown, sprayed or splashed during the session and participants should expect to get covered in paint.

We want everyone to have an enjoyable and safe experience, but participation is at your own risk.

2. Participation

By booking, you confirm that:

  • You are physically able to participate safely in the activity.
  • You will follow all instructions given by The Mad Splatter staff.
  • You will behave responsibly and respectfully towards staff, other participants and the premises.
  • You will not deliberately behave in a way that could put yourself or another person at risk.
  • You understand that the activity involves physical movement and the possibility of slipping, tripping or falling.
  • You will immediately tell a member of staff if you feel unwell, injured or unable to continue.
  • You understand that paint and other materials may come into contact with your clothing, skin, hair and footwear.

The Mad Splatter reserves the right to stop or refuse participation if a person is behaving dangerously, aggressively, appears intoxicated or is otherwise considered unable to participate safely.

3. Children & Young People

Children and young people must be supervised by a responsible adult in accordance with the booking requirements.

The responsible adult remains responsible for the child/children in their care throughout the visit unless The Mad Splatter has specifically stated otherwise.

Adults accompanying children must:

  • Follow staff instructions.
  • Ensure children behave safely.
  • Ensure children do not deliberately target other participants in an unsafe manner.
  • Inform staff of any relevant needs that may affect safe participation.

Children must not be left unattended.

4. Paint & Clothing

Paint is used throughout the experience and staining or damage to clothing and personal belongings is possible.

The Mad Splatter provides protective clothing where included in the booking, but this does not guarantee that clothing underneath will remain clean or undamaged.

We strongly recommend:

  • Wearing old clothing.
  • Wearing closed-toe shoes.
  • Removing valuable jewellery and accessories.
  • Securing long hair.
  • Avoiding expensive clothing, shoes or belongings.

The Mad Splatter cannot accept responsibility for damage to clothing or personal possessions resulting from participation in the activity, except where liability cannot legally be excluded.

5. Eyes, Face & Skin

Participants must follow staff instructions regarding the safe use of paint and equipment.

Paint should not intentionally be directed into another person's eyes, mouth or face.

If paint enters the eyes, participants should immediately notify a member of staff and follow the appropriate first-aid instructions.

Participants should inform staff before participating if they have known allergies, sensitivities or other concerns relating to the materials being used.

6. Allergies & Medical Conditions

Customers are responsible for informing The Mad Splatter before participation of any allergy, medical condition, disability or other circumstance that may affect their ability to participate safely.

We will make reasonable efforts to accommodate disclosed requirements where possible.

If you are unsure whether the activity is suitable for you or your child, please contact us before booking.

7. Slips, Trips & Falls

The nature of the experience means that floors and surfaces may become wet or covered with paint.

Participants must:

  • Walk rather than run unless specifically instructed otherwise.
  • Follow staff instructions.
  • Take care when moving around the studio.
  • Wear appropriate footwear.
  • Report spills or hazards to staff immediately.

Participants understand that there is an increased risk of slips and falls associated with a paint-splatter environment.

8. Alcohol

Alcohol may only be consumed where specifically permitted by The Mad Splatter and in accordance with the rules of the particular event.

Anyone who appears intoxicated or whose behaviour creates a safety concern may be refused participation or asked to leave.

No refund will necessarily be provided where participation is refused due to inappropriate or unsafe behaviour.

9. Prohibited Behaviour

The following are not permitted:

  • Fighting or physical aggression.
  • Deliberately causing injury to another person.
  • Throwing objects other than those specifically provided for the activity.
  • Deliberately damaging the premises or equipment.
  • Unsafe climbing.
  • Running in areas where it creates a safety risk.
  • Abusive, threatening or discriminatory behaviour towards staff or customers.
  • Any behaviour that staff reasonably believe creates a danger to yourself or another person.

The Mad Splatter reserves the right to immediately end a person's participation if they breach these rules.

10. Damage to Property

Customers may be liable for damage caused deliberately or through reckless or irresponsible behaviour.

Normal wear and tear associated with the activity is not considered customer damage.

11. Personal Belongings

Customers are responsible for their own personal belongings.

Valuable items should not be brought into the splatter area.

The Mad Splatter cannot accept responsibility for loss or damage to personal possessions unless caused by circumstances for which we are legally responsible.

12. Photography & Video

The Mad Splatter may take photographs or videos during sessions for promotional purposes.

Where appropriate, we will seek consent in accordance with our photography policy.

If you do not want yourself or your child to appear in promotional photographs or videos, please inform a member of staff before the session.

Customers must not photograph or film other participants without their permission.

13. Staff Instructions

For everyone's safety, staff instructions must be followed at all times.

Staff may pause or stop an activity where they believe there is a safety concern.

The decision of The Mad Splatter staff regarding the safe operation of an activity is final.

14. Emergencies & Evacuation

If the fire alarm sounds or staff instruct you to evacuate:

  • Stop the activity immediately.
  • Follow staff instructions.
  • Leave by the designated safe exit.
  • Do not stop to collect belongings.
  • Do not re-enter the premises until authorised to do so.

Customers must cooperate fully with emergency procedures.

15. Liability

The Mad Splatter takes reasonable steps to provide a safe environment and appropriate safety instructions.

Nothing in these terms is intended to exclude or restrict any liability that cannot legally be excluded or restricted, including liability for death or personal injury caused by negligence, fraud or any other liability that cannot legally be limited.

Subject to the above, The Mad Splatter is not responsible for loss, damage, injury or expense arising from participation where this results from the customer's own actions, failure to follow safety instructions or other circumstances outside The Mad Splatter's reasonable control.

16. Refunds & Cancellations

Bookings are subject to The Mad Splatter's booking and cancellation policy.

Please ensure you have read the cancellation terms before completing your booking.

Acceptance

By completing a booking, you confirm that:

  • •I have read and understood The Mad Splatter Customer Waiver & Terms of Participation.
  • •I agree to follow all safety instructions given by The Mad Splatter staff.
  • •I understand that the activity involves paint, movement and an increased risk of slips, trips and falls.
  • •I understand that paint may stain or damage clothing and personal belongings.
  • •I confirm that I have disclosed any relevant medical conditions, allergies or other information that may affect safe participation.
  • •I understand that children remain the responsibility of their accompanying adult unless otherwise agreed with The Mad Splatter.
  • •I understand that The Mad Splatter may stop my participation if I behave in an unsafe or inappropriate manner.
  • •I confirm that I am accepting these terms on behalf of myself and, where applicable, the children or other participants included in my booking for whom I am responsible.
